案情简介：2014年某月某日下午，当事人驶一辆丰田越野车驶至xx路中断时，因开车疏忽撞向了一摩托车。摩托车被撞倒，死者x某（女，孕妇）撞倒后被小车碾压经抢救无效死亡，死者丈夫y某被撞成轻伤。当事人见事态严重赶快逃跑，20分钟后投案自首。经调查，死者有兄妹共三人，父亲51岁，有稳定收入，母亲无固定收入来源。

分析：依据《最高院关于审理人身损害赔偿案件适用法律若干问题的解释》

第一条的规定，本条的“赔偿权利人”是指因侵权行为或者其他致害原因直接遭受人身损害的受害人、依法由受害人承担扶养义务的被扶养人以及死亡受害人的近亲属。根据《人身损害解释》第28条的规定，被扶养人是指受害人依法应当承担扶养义务的未成年人或者丧失劳动能力又无其他生活来源的成年近亲属。所以本案应认定为无受害人承担扶养义务的被扶养人。所以本案的赔偿请求人是死者的近亲属（本案即死者的丈夫，父母、兄妹）。依据《人身损害解释》第十七条十八条十九条的规定，结合本案，交通肇事死亡赔偿的范围包括：医疗费、交通费、丧葬费、死亡赔偿金、精神损害赔偿金等。依据最高院关于确定民事侵权精神损害赔偿责任若干问题的解释本案中赔偿请求人获得的赔偿为：(以下均以赣州市上一年度平均收入水平为准)

5、其余财产损失：车辆维修费100元
